These proceedings were commenced by Milwaukee county pursuant to sec. 46.106(4), Stats., to recover from the State of Wisconsin
an amount for institutional charges claimed to have been erroneously assessed against the said county in the case of Dorothy
Krznarich, an insane person, who was committed to the Winnebago State Hospital on March 1, 1943. The State Department of Public
Welfare, after a hearing upon Milwaukee county's petition in the matter, determined that Dorothy Krznarich's legal settlement
was in Milwaukee county at the time of her commitment; that such settlement was derived through her husband, Ignatz Krznarich;
that the charges assessed against Milwaukee county for the care of the patient were correct; and that Milwaukee county was
not entitled to be relieved of the charge. The county's petition was ordered dismissed. Thereafter, Milwaukee county pursuant
to authority in ch. 227, Stats., petitioned the circuit court of Dane county for a review of the Department's order. Following
a hearing, the court by judgment affirmed the order of the Department. This appeal is from said judgment. The material facts
